Terms of Service

These Terms of Service ("Terms") govern your access to and use of CoatMap Pro ("CoatMap Pro," "we," "us," or "our"), a software product operated by EpoxyLocator. By creating an account, starting a trial, or otherwise using CoatMap Pro, you agree to these Terms. If you are using CoatMap Pro on behalf of a business, you are agreeing on that business's behalf and confirming you have the authority to do so.

1. Acceptance of Terms

By accessing or using CoatMap Pro, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. Description of Service

CoatMap Pro is a business-management platform built for coating and epoxy contractors. It includes a lead inbox for two-way texting and calls, a CRM for tracking contacts and job history, a job board for tracking work from lead to completion, a quote builder, an appointment calendar, and reporting on revenue and pipeline. We may add, change, or remove features over time.

3. Account Registration & Eligibility

You must provide accurate information when creating an account and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must be at least 18 years old and able to form a binding contract to use CoatMap Pro.

4. Subscription, Billing, Trial & Cancellation

Paid plans are billed on a recurring basis and processed by our payment processor, Stripe. New accounts start with a free trial period; you will not be charged until the trial ends. Founding-member pricing, where offered, is locked in for as long as your subscription remains active and in good standing. You can cancel at any time from your account settings; cancellation takes effect at the end of your current billing period. Except where required by law, fees already paid are non-refundable.

5. Acceptable Use

You agree not to use CoatMap Pro to: violate any law or regulation; send unsolicited, deceptive, or abusive messages; harass, defraud, or impersonate any person; interfere with or disrupt the service or its infrastructure; or attempt to access another customer's account or data without authorization.

6. SMS/Text Messaging Consent & Compliance

CoatMap Pro's texting features are powered by Twilio. When you use CoatMap Pro to text your leads and customers, you — not CoatMap Pro — are responsible for obtaining any consent required under the Telephone Consumer Protection Act (TCPA) and other applicable messaging laws before texting them, for honoring opt-out requests, and for the content of the messages you send. CoatMap Pro provides the tools; you are responsible for using them lawfully.

7. Customer Data & Content Ownership

You retain ownership of the business data you enter into CoatMap Pro — your contacts, jobs, quotes, notes, and messages ("Customer Data"). You grant us a license to host, process, and display Customer Data solely as needed to operate and improve the service for you. We do not sell Customer Data.

8. Third-Party Services

CoatMap Pro relies on third-party services to operate, including Stripe (payments), Supabase (database/authentication), Twilio (calling and texting), Resend (transactional email), and, if you connect them, Google APIs for your own Gmail, Calendar, and Google Business Profile. Your use of those integrations is also subject to each provider's own terms.

9. Intellectual Property

CoatMap Pro, including its software, design, and branding, is owned by us and our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

10. Disclaimers & Limitation of Liability

CoatMap Pro is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities arising from your use of the service. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim arose.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of CoatMap Pro, your violation of these Terms, or your violation of any law or third party's rights.

12. Termination

We may suspend or terminate your access to CoatMap Pro if you violate these Terms or if we discontinue the service, with notice where reasonably possible. You may stop using CoatMap Pro and cancel your subscription at any time.

13. Governing Law & Disputes

These Terms are governed by the laws of [State — TODO: confirm governing-law jurisdiction], without regard to its conflict-of-laws principles, and any disputes will be resolved in the courts located in that state, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you directly. Continued use of CoatMap Pro after changes take effect constitutes acceptance of the revised Terms.
